DMCA Policy
Copper & Canyon respects the intellectual property rights of others and expects the same from everyone who uses copperandcanyon.com (the “Site”). Under the Digital Millennium Copyright Act of 1998 (“DMCA”), in particular 17 U.S.C. §512(c)(3), we respond promptly to properly submitted notices of alleged infringement.
How to submit a notice of infringement
Send your notice to support@copperandcanyon.com. To be valid under the DMCA, it must substantially include:
- Identification of the copyrighted work you believe is infringed (or, for several works, a representative list).
- Identification of the allegedly infringing material, with enough information to locate it, including the exact URLs on the Site.
- Your name, postal address, phone number and email address.
- A statement that you believe in good faith that the disputed use is not authorised by the rights holder, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the rights holder or authorised to act on its behalf.
- Documentation of your ownership or authorisation (for example a copyright registration, trademark certificate, licence or power of attorney).
- Your physical or electronic signature.
A notice that omits any of the requirements of 17 U.S.C. §512(c)(3) may not be valid or actionable under the DMCA and may not be acted on.
Notices made in bad faith
Under 17 U.S.C. §512(f), anyone who knowingly and materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees incurred by the alleged infringer and by us in handling the false notice. If in doubt, please consult a lawyer before submitting.
Counter-notice
If your material was removed or disabled following a notice and you believe this was a mistake or misidentification, you may send a written counter-notice including: your signature; identification of the removed material and where it appeared before removal; a statement under penalty of perjury that you believe in good faith the removal was due to a mistake or misidentification; and your name, address, phone number and a statement that you consent to the jurisdiction of the appropriate federal court and will accept service from the party who submitted the original notice.
On receiving a valid counter-notice, we may restore the material within 10–14 business days, unless the original complainant tells us they have filed a court action to restrain the activity.
Repeat infringers
Where appropriate, we will terminate the accounts of repeat infringers.
This policy is for information and is not legal advice. The DMCA is a US law (17 U.S.C. §512); we refer to it in connection with the US-based service infrastructure we use.
